These Terms of Service ("Terms") govern your access to and use of www.steadwellpets.com (the "Site") and your purchase of products from [LEGAL ENTITY NAME] ("Steadwell," "we," "us," or "our"). By accessing the Site or placing an order, you agree to these Terms. If you do not agree, do not use the Site.

PLEASE READ SECTIONS 11 THROUGH 13 CAREFULLY. THEY LIMIT OUR LIABILITY AND REQUIRE INDIVIDUAL ARBITRATION AND A WAIVER OF CLASS ACTIONS FOR MOST DISPUTES.

  1. ELIGIBILITY AND ACCEPTANCE

You must be at least 18 years old and able to form a binding contract to use the Site or place an order. By using the Site, you represent that you meet these requirements and that the information you provide is accurate.

  1. CHANGES TO THESE TERMS

We may modify these Terms at any time. The "Last updated" date reflects the most recent changes. Changes are effective when posted. Your continued use of the Site after changes are posted constitutes acceptance.

  1. PRODUCTS, DESCRIPTIONS, AND AVAILABILITY

We work to describe and display our products accurately, but we do not warrant that descriptions, images, colors, dimensions, or other content are complete, current, or error-free. Product colors and finishes may vary due to photography, screens, and natural variation in materials such as wood. Products are subject to availability, and we may discontinue or modify products at any time.

  1. ORDERS, PRICING, AND PAYMENT

All prices are listed in the currency shown at checkout and are subject to change without notice. We reserve the right to refuse, limit, or cancel any order, including for suspected fraud, resale, pricing or product errors, or limited availability. If we cancel an order you have already paid for, we will issue a refund to your original payment method.

In the event of an obvious pricing or typographical error, we are not obligated to honor the incorrect price and may cancel any affected order, even after it is confirmed.

Payment is processed by our third-party payment providers. You authorize us and our providers to charge your selected payment method for your order total, including applicable taxes and shipping. You are responsible for any applicable taxes, duties, or customs charges (see our Shipping Policy).

  1. PROMOTIONS AND DISCOUNTS

Discount codes, promotions, and bundle offers are subject to their stated terms, may be modified or withdrawn at any time, cannot be combined unless stated, and have no cash value.

  1. PRODUCT SAFETY AND PROPER USE; ASSUMPTION OF RISK

Our products are pet mobility aids intended for ordinary household use. Your safe use of the product is your responsibility. By purchasing and using a Steadwell product, you agree that you will:

  • Follow all included instructions for assembly, height adjustment, placement, and use.
  • Place the ramp on a stable, level, non-slip surface before each use and confirm it is secure.
  • Use the product only within the recommended weight guidance provided with the product.
  • Inspect the product before each use and discontinue use if any part is loose, worn, cracked, or damaged.
  • Supervise your pet, especially during the first uses and while your pet is learning to use the ramp.

IMPORTANT: Our products are not medical or veterinary devices. We do not diagnose, treat, cure, or prevent any disease, injury, or medical condition, and nothing on the Site or in our marketing is veterinary advice. Individual results vary. Consult a qualified veterinarian regarding your pet's health, mobility, and whether a ramp is appropriate for your pet.

To the fullest extent permitted by law, you assume all risk arising from the use or misuse of the product, including any risk of injury to your pet, yourself, or others, or damage to property.

  1. INTELLECTUAL PROPERTY

The Site and its content, including text, graphics, logos, images, product designs, and the "Steadwell" name and marks, are owned by us or our licensors and are protected by intellectual property laws. We grant you a limited, revocable, non-exclusive, non-transferable license to access the Site for personal, non-commercial use. You may not copy, reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

  1. USER CONDUCT

You agree not to use the Site to violate any law, infringe others' rights, transmit harmful code, interfere with the Site's operation, attempt unauthorized access, scrape or harvest data, or engage in fraudulent or deceptive activity.

  1. REVIEWS AND USER CONTENT

If you submit reviews, photos, comments, or other content, you grant us a worldwide, royalty-free, perpetual, irrevocable, non-exclusive license to use, reproduce, display, and distribute that content in connection with our business. You represent that your content is accurate, that you own or have the rights to it, and that it does not violate any law or third-party right. We may remove content at our discretion.

  1. THIRD-PARTY LINKS AND SERVICES

The Site may link to or rely on third-party websites and services, including our hosting, payment, shipping, and advertising partners. We are not responsible for third-party content, products, or practices.

  1. DISCLAIMER OF WARRANTIES

TO THE FULLEST EXTENT PERMITTED BY LAW, THE SITE AND PRODUCTS ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you. Where such warranties cannot be excluded, they are limited to the minimum scope and duration permitted by law. Nothing in these Terms removes any non-waivable statutory rights you may have as a consumer.

  1. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL STEADWELL, ITS OWNERS, OFFICERS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST DATA, OR LOSS OF GOODWILL, ARISING OUT OF OR RELATING TO THE SITE OR PRODUCTS, WHETHER BASED IN CONTRACT, TORT, OR ANY OTHER THEORY, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATING TO THE SITE OR ANY PRODUCT WILL NOT EXCEED THE AMOUNT YOU ACTUALLY PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law, such as liability for death or personal injury caused by our negligence, fraud, or willful misconduct.

  1. DISPUTE RESOLUTION; ARBITRATION; CLASS WAIVER

Informal resolution: Before filing a claim, you agree to first contact us at help@steadwellpets.com and attempt to resolve the dispute informally for at least 30 days.

Governing law: These Terms are governed by the laws of the State of Pennsylvania, without regard to its conflict-of-laws rules, except where applicable consumer law in your place of residence requires otherwise.

Arbitration and class waiver: To the fullest extent permitted by law, you and Steadwell agree that any dispute not resolved informally will be resolved by binding individual arbitration rather than in court, except that either party may bring an individual claim in small-claims court. YOU AND STEADWELL WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS ACTION. The enforceability of this provision is subject to applicable law, and it does not apply where prohibited. Consumers in some jurisdictions retain the right to bring claims in their local courts and under their local consumer-protection laws, and nothing here waives non-waivable rights.

Time to bring a claim: To the extent permitted by law, any claim arising out of or relating to the Site or products must be filed within one (1) year after the claim arose, or it is permanently barred.

  1. INDEMNIFICATION

To the fullest extent permitted by law, you agree to indemnify and hold harmless Steadwell and its owners, officers, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Site or products, or your violation of any law or third-party right.

  1. GENERAL

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect. Our failure to enforce any right is not a waiver. You may not assign these Terms without our consent; we may assign them freely. We are not liable for failure or delay in performance due to causes beyond our reasonable control. These Terms, together with our Privacy Policy, Refund Policy, and Shipping Policy, are the entire agreement between you and us regarding the Site and products.
